Bodhi Terms & Conditions
Effective Date: August 14, 2026
Last Updated: August 14, 2026
These Terms & Conditions (“Terms”) govern your access to and use of Bodhi, including the Bodhi mobile application, website, subscriptions, student profiles, parent/guardian profiles, teacher tools, school-linked features, meditation content, focus tools, Thought Bank, Bro, Dopameter, Karma, notifications, support services, and related services.
Bodhi is operated by Shyam Hitendra Trambadia, sole proprietor carrying on business under the trade name Neurosynthesis Lab, having its business address at 404, Silver Cross Building, Satellite Road, Near Shivranjani Char Rasta, Shivranjani Junction, Ahmedabad, Gujarat – 380015, India (“Bodhi”, “Neurosynthesis Lab”, “we”, “us”, or “our”).
By creating an account, using Bodhi, purchasing a subscription, starting a free trial, joining a school-linked program, or allowing a child to use Bodhi, you agree to these Terms.
If the user is below 18 years of age, these Terms must be accepted by the user’s parent or lawful guardian through Bodhi’s parent consent process or another legally valid consent process approved by Bodhi and, where applicable, the school.
These Terms should be read together with Bodhi’s Privacy Policy, Child/Parent Consent Notice, Cancellation & Refund terms, and any school-specific agreement.
1. About Bodhi
Bodhi is a meditation-led mind training, self-regulation, focus, reflection, and wellbeing-practice platform. Bodhi may include guided meditations, breathwork, focus tools, Thought Bank, Bro, Dopameter, Karma, reminders, practice streaks, school-linked League activities, teacher-assigned practices, subscriptions, and related features.
Bodhi is designed to support self-awareness, consistency, focus, emotional balance, reflection, and healthy practice habits.
Bodhi is not a medical service, therapy service, counselling service, psychiatric service, emergency service, crisis-response service, diagnostic tool, or medical device.
2. Eligibility and Age
Bodhi is intended for users aged 8 and above, including students, parents, guardians, teachers, schools, and adult individual users.
Users below 18 years of age may use Bodhi only with appropriate parent or lawful guardian consent, or through a valid school-facilitated consent process where legally appropriate.
If you are a parent, guardian, teacher, school administrator, or authorised school representative using Bodhi on behalf of a child, student, class, or school, you confirm that you have the authority to do so.
Bodhi may restrict, suspend, or terminate access if we reasonably believe that required consent has not been obtained, is disputed, has been withdrawn, or that the account has been created using false, misleading, or unauthorised information.
3. Child Users and Parent/Guardian Consent
Because Bodhi may be used by children and students, we take additional care with child accounts and student data.
Where a user is below 18, Bodhi requires parent or lawful guardian consent before the child account is activated. Bodhi may obtain this consent through mobile OTP verification, email OTP verification, parent account confirmation, school-facilitated consent, or another consent process approved by Bodhi.
For individual under-18 users, the standard consent process is:
- the user enters date of birth during onboarding;
- if the user is below 18, Bodhi requests the parent or lawful guardian’s mobile number or email address;
- the parent or lawful guardian receives an OTP or verification link;
- the parent or lawful guardian reviews and accepts the relevant Terms, Privacy Policy, and consent notice;
- the child account is activated only after successful verification.
Users must provide the genuine mobile number or email address of their parent or lawful guardian. A child must not enter their own contact details, a friend’s contact details, or any unauthorised contact details in place of the parent or lawful guardian.
By completing the parent verification process, the person providing consent confirms that they are the parent or lawful guardian of the child and that they consent to the child’s use of Bodhi.
OTP or email verification confirms access to the mobile number or email address used for consent. It does not by itself prove parenthood in every possible situation. Bodhi relies on the accuracy of the information provided, the parent/guardian confirmation, consent records, and school-facilitated processes where applicable.
Parents and lawful guardians are responsible for:
- reviewing these Terms and the Privacy Policy;
- deciding whether Bodhi is suitable for their child;
- providing accurate consent and account information;
- supervising the child’s use of Bodhi where appropriate;
- contacting Bodhi if they wish to withdraw consent, request deletion, or raise a concern.
A child simply clicking “I agree” is not treated as sufficient parent or guardian consent where parent consent is legally required.
If consent is withdrawn, the child may lose access to some or all Bodhi features, including school-linked features, subscriptions, League participation, linked profiles, reminders, practice history, and other services.
Bodhi does not use child data for targeted advertising. Bodhi does not use screen recording, session replay, heatmap tools, or hidden surveillance tools in the student-facing mobile app.
4. Accounts and Registration
To use Bodhi, users may need to create an account using a mobile number, email address, OTP, password, date of birth, class code, school verification, or another approved method.
Users agree to:
- provide accurate and current information;
- keep login credentials secure;
- not share OTPs, passwords, PINs, or account access with unauthorised persons;
- not impersonate another person;
- not misuse school names, class codes, teacher accounts, parent accounts, guardian accounts, or student identities;
- notify Bodhi if unauthorised account access is suspected.
Users are responsible for activity that occurs through their account, except where the activity results from Bodhi’s own security failure or applicable law provides otherwise.
5. Student Profile and Parent/Guardian Profile Hierarchy
For child or student accounts, the student profile is the primary Bodhi profile for which the subscription is purchased or access is provided.
Parent, mother, father, or guardian profiles are linked support profiles created for consent, subscription management, account support, linked-profile management, and limited visibility where enabled.
A linked parent or guardian profile does not create a separate independent subscription entitlement, ownership right over the student’s private content, or unrestricted access to the student’s app data.
Parent or guardian access is subject to Bodhi’s product design, consent settings, privacy safeguards, and applicable law.
If the primary student profile is deleted, linked parent or guardian profiles associated with that student profile may also be deleted as part of the same account deletion process, subject to legal, payment, tax, security, fraud-prevention, and backup-cycle requirements.
6. School-Linked Use
Bodhi may be used by schools, classes, teachers, counsellors, principals, administrators, or other authorised representatives.
School-linked features may include:
- class codes;
- teacher-assigned meditations or practices;
- League participation;
- student/class grouping;
- completion or pending status for assigned activities;
- school-paid or school-promoted access;
- limited class or program-level insights where separately agreed.
School-linked use may be governed by a separate written agreement between Neurosynthesis Lab and the school. If there is a conflict between these Terms and a signed school agreement, the school agreement will apply only for the relevant school program and only to the extent of that conflict.
Schools are responsible for ensuring that they have the required authority, parent permissions, institutional approvals, and internal policies before enabling students to use Bodhi.
7. Teacher and School Visibility
Teachers and authorised school representatives may be able to see limited school-program information such as:
- student name or profile identifier;
- class and section;
- assigned practice;
- completion or pending status for assigned activities;
- class-level participation information;
- limited Karma-related information where Karma is enabled and where such visibility is part of the product design or school configuration.
Teachers and schools are not permitted to use Bodhi data to shame, punish, discipline, discriminate against, publicly rank, label, or unfairly profile students.
Bodhi does not provide teachers or schools with private Thought Bank entries, Bro conversations, individual Dopameter responses, private reflections, psychological diagnoses, mental-health labels, behavioural risk scores, disciplinary scores, or private journal content.
8. School Reports, Consultations and Offline Services
A Bodhi app subscription provides access to the mobile application and available in-app features according to the applicable plan.
Any school-level reports, reviews, presentations, workshops, consultations, advisory support, founder reviews, or offline/institutional services provided by Neurosynthesis Lab are separate services. They may be offered as an add-on, courtesy, pilot support, institutional engagement, or separately agreed service.
Such services are not guaranteed as part of an individual app subscription unless expressly agreed in writing by Neurosynthesis Lab.
Where Neurosynthesis Lab separately works with a school, it may prepare aggregated or limited program-level insights using practice and progress data, subject to applicable consent, school agreement, privacy safeguards, and the Privacy Policy.
Aggregated institutional insights are designed to avoid identifying individual students. Thought Bank content, Bro conversations, journal text, and private reflections are never included in school reports or institutional insights.
Such reports or insights are not medical reports, psychological assessments, counselling notes, behavioural risk profiles, disciplinary reports, or academic performance reports.
9. Thought Bank
Bodhi may include a private reflection feature called Thought Bank.
Thought Bank is intended for personal reflection. It is not a counselling channel, emergency channel, school complaint channel, therapy channel, reporting channel, or crisis-response system.
Thought Bank entries are encrypted before storage using AES-256 encryption. The encrypted entries are stored through Bodhi-managed systems and contracted hosting/database infrastructure. Bodhi does not provide an admin interface for viewing Thought Bank entries, and Bodhi’s team is not intended or permitted to access user entries during normal operations.
Because encryption keys are currently stored through Bodhi-managed systems and not only on the user’s device, Thought Bank should not be described as end-to-end encrypted or zero-knowledge encrypted unless the technical architecture changes.
Thought Bank entries are not shared with teachers, schools, parents, guardians, or third parties unless legally required, expressly authorised by the user or parent/guardian where applicable, or necessary for lawful security/compliance purposes.
Bodhi does not monitor Thought Bank entries in real time. Bodhi cannot provide emergency intervention based on Thought Bank entries.
Users should not use Thought Bank to store unlawful, abusive, threatening, sexually explicit, exploitative, defamatory, hateful, harmful-to-children, or privacy-violating content.
If a user is unsafe, experiencing self-harm thoughts, facing abuse, or in a medical or mental-health emergency, they should immediately contact a trusted adult, parent, guardian, school counsellor, qualified professional, local emergency service, or crisis helpline.
10. Bro
Bodhi may include a rule-based conversational feature called Bro.
Bro is designed to help users express what they are feeling, navigate app features, and receive general Bodhi practice suggestions based on predefined rules and product logic.
Bro is not a human counsellor, therapist, doctor, psychologist, psychiatrist, teacher, emergency responder, crisis hotline, or professional advisor. Bro does not provide medical, psychological, psychiatric, legal, academic, disciplinary, or emergency advice.
Bro does not diagnose, treat, cure, prevent, assess, or monitor any medical, mental-health, behavioural, emotional, academic, or psychological condition.
Bro responses are generated through rule-based logic. Bro should not be relied on for emergencies, crisis situations, self-harm situations, abuse reporting, medical concerns, legal concerns, or decisions requiring professional judgement.
Bro conversations are not stored by Bodhi after the interaction/session and are not visible to teachers, schools, parents, guardians, admins, developers, or support staff through any normal product interface.
Bodhi does not monitor Bro conversations in real time and cannot provide emergency intervention based on Bro messages.
If a user is unsafe, experiencing self-harm thoughts, facing abuse, or in a medical or mental-health emergency, they should immediately contact a trusted adult, parent, guardian, school counsellor, qualified professional, local emergency service, or crisis helpline.
Users must not use Bro to submit unlawful, abusive, sexually explicit, exploitative, hateful, harmful-to-children, threatening, defamatory, or privacy-violating content.
11. Dopameter, Self-Reflection and Recommendations
Bodhi may include Dopameter, mood, energy, focus, habit, reflection, or self-check-in tools.
These tools are intended to support self-awareness and practice selection. They are not diagnostic tools and should not be treated as medical, psychological, psychiatric, therapeutic, counselling, academic, or professional advice.
Any recommendations, insights, streaks, scores, reminders, or suggestions provided by Bodhi are general wellbeing-practice aids. They should not be used as a substitute for professional advice.
Individual Dopameter responses are not visible to teachers or schools.
Aggregated or de-identified Dopameter trends may be used for personal insights, product improvement, or separately agreed program-level insights, subject to the Privacy Policy and applicable consent requirements.
12. Karma
Bodhi may include a Karma feature that allows certain users, teachers, or authorised roles to give or receive recognition within the app.
Karma may be enabled, disabled, limited, or configured depending on the product version, user type, school/program requirements, beneficiary settings, and admin controls.
Karma may include data such as sender, recipient, amount, reason, category, timestamp, class/program link, and related transaction information.
Karma is intended to encourage positive recognition, kindness, accountability, support, consistency, and healthy participation. It is not intended to create unhealthy comparison, bullying, public ranking, disciplinary scoring, behavioural profiling, or emotional pressure.
Users must not misuse Karma to bully, mock, shame, pressure, manipulate, target, exclude, harass, or unfairly influence another user.
Bodhi may notify a user when they receive Karma or when a Karma-related action occurs. Full Karma history is not visible to users, peers, parents, guardians, or teachers unless Bodhi clearly enables such visibility in a future product version. Admin access to Karma records may be used for product operation, moderation, support, fraud prevention, misuse investigation, and integrity of the Karma system.
Bodhi may suspend, reverse, limit, remove, or investigate Karma transactions where misuse, manipulation, bullying, fraud, error, or policy violation is suspected.
Karma does not represent money, property, academic credit, legal entitlement, guaranteed reward, or transferable value.
13. League and Class Activities
Bodhi may include League features where teachers assign practices to a class or selected students.
The League is intended to encourage consistency, participation, and shared practice. It is not intended to create unhealthy comparison, public shaming, academic pressure, disciplinary ranking, behavioural scoring, or emotional pressure.
Depending on the app design, teachers or authorised school representatives may see limited completion-related information, such as whether an assigned practice was completed or pending. Private reflection content, Thought Bank entries, Bro conversations, and individual Dopameter responses are not part of teacher or school visibility.
Users must not use League features to bully, mock, harass, pressure, shame, or exclude other students.
14. Subscriptions, Free Trials and Payments
Bodhi may offer free access, free trials, paid subscriptions, school-paid access, school-promoted access, website subscriptions, in-app subscriptions, pilot access, promotional access, or other plans.
Subscription features, pricing, duration, renewal terms, trial period, cancellation rules, and refund eligibility will be shown at the time of purchase, onboarding, or offer presentation.
Bodhi may offer different access models, including:
- individual subscription;
- Apple in-app purchase subscription for iOS users;
- website subscription purchased through Bodhi’s website;
- Razorpay or other authorised payment gateway purchase;
- school invoice or institutional purchase;
- school-paid access;
- school-promoted self-paid access;
- free trial access;
- promotional or limited-time offers;
- pilot access;
- limited free content.
For iOS users, subscriptions offered inside the iOS app may be processed through Apple In-App Purchase. Apple in-app purchase pricing may differ from website pricing or other channel pricing. The iOS app will not display website-price comparisons or direct users to purchase through an external payment method where such direction is not permitted by Apple’s rules.
Users who purchase a subscription through Bodhi’s website, school link, institutional route, or another authorised external channel may be able to log in and access Bodhi on supported devices if the same account has an active subscription.
For website purchases, payments may be processed through Razorpay or another authorised payment provider.
For Android users, any subscription purchase flow offered inside the Google Play-distributed Android app will be implemented according to the applicable Google Play billing or permitted alternative billing requirements for the relevant region and product configuration. Website or school-link purchases made outside the Android app may be recognised by Bodhi for account access where applicable.
For school invoice purchases, payment, access, renewal, refund, cancellation, and user eligibility may be governed by the arrangement between Neurosynthesis Lab and the school.
Bodhi may change pricing, plans, features, subscription structures, offers, trials, or access models from time to time. Prices may differ by platform, channel, offer, school, plan, tax treatment, payment provider, app-store rules, or promotion.
15. Free Trials and Promotional Offers
Bodhi may offer a free trial or promotional access for certain users, plans, schools, platforms, or campaigns.
The applicable trial duration, price after trial, renewal terms, cancellation method, access period, and payment requirement will be shown at the time of offer or purchase.
Where a free trial converts into a paid subscription, users are responsible for cancelling before the trial ends if they do not wish to be charged, unless the offer terms state otherwise.
Bodhi may limit free trials or offers to one per user, device, phone number, email, family, school, payment account, or other reasonable eligibility criteria.
Bodhi may modify, restrict, withdraw, or refuse promotional offers where misuse, duplication, fraud, or technical error is suspected.
16. Cancellations and Refunds
All subscription purchases are generally non-refundable unless required by applicable law, platform policy, or expressly stated in the applicable offer terms.
Users may contact Bodhi support to request refund-related assistance, cancellation-related assistance, billing clarification, or review of a specific case.
Any refund, credit, extension, adjustment, or other resolution offered by Bodhi is provided at Bodhi’s sole discretion as a goodwill or customer-support measure and does not create a refund entitlement, future obligation, or admission of legal liability.
If the subscription is purchased through Apple In-App Purchase, cancellation and refund requests may need to be handled through Apple according to Apple’s policies and account settings.
If the subscription is purchased through Bodhi’s website, Razorpay, school invoice, payment link, or another direct channel, cancellation and refund-related requests may be handled by Bodhi support or according to the applicable school or institutional arrangement.
Deleting the app does not automatically cancel a paid subscription. Users must cancel subscriptions through the relevant app store, website account flow, payment method, or support process.
Nothing in these Terms limits rights that cannot be limited under applicable consumer protection law.
17. Acceptable Use
Users agree not to:
- use Bodhi for unlawful, harmful, abusive, exploitative, fraudulent, or misleading purposes;
- harass, bully, threaten, shame, or target another user;
- upload, enter, or share content that is sexually explicit, violent, hateful, discriminatory, defamatory, exploitative, or harmful to children;
- impersonate another student, parent, guardian, teacher, school, or Bodhi representative;
- misuse class codes or join a school/class without permission;
- attempt to access another person’s account, profile, Thought Bank, Bro conversations, or private data;
- copy, scrape, reverse engineer, decompile, modify, or create derivative works from Bodhi except where allowed by law;
- interfere with Bodhi’s servers, security systems, payment systems, or app functionality;
- use bots, scripts, automation, or unauthorised tools to manipulate usage, streaks, Karma, reports, subscriptions, or access;
- bypass subscription, trial, app-lock, class-code, parental consent, or access controls;
- use Bodhi data to shame, rank, punish, discriminate against, or unfairly profile students;
- resell, redistribute, sublicense, or commercially exploit Bodhi without written permission.
Bodhi may suspend or terminate accounts that violate these Terms.
18. User Content
Users may submit, create, or store content in Bodhi, including Thought Bank entries, Bro messages during active interactions, reflection inputs, profile details, support messages, feedback, or other content.
Users retain ownership of their own content, subject to the limited rights Bodhi needs to operate the service.
For ordinary account, profile, support, and operational content, users grant Bodhi a limited, non-exclusive, worldwide, royalty-free licence to host, store, process, transmit, back up, secure, display, and use such content only as necessary to provide Bodhi, maintain security, offer support, comply with law, and improve the service in accordance with the Privacy Policy.
For private Thought Bank entries and Bro interaction content, Bodhi’s permission is limited to the technical handling required to receive, process, encrypt where applicable, store where applicable, transmit, back up where applicable, return/display to the user, secure, and delete such content according to the Privacy Policy. Bodhi does not use private Thought Bank entries or Bro conversation content for advertising, public AI model training, school reports, diagnosis, behavioural profiling, or general product-improvement review by staff.
Bodhi does not claim ownership over private Thought Bank entries or Bro interaction content.
Users are responsible for the content they enter into Bodhi and must ensure it does not violate these Terms or the rights of others.
19. Bodhi Content and Intellectual Property
All rights in Bodhi, including the app, design, interface, name, brand, logo, meditations, scripts, audio, visuals, software, workflows, reports, frameworks, text, graphics, icons, animations, product features, and other materials belong to Neurosynthesis Lab or its licensors.
Users may use Bodhi only for personal, family, school, or authorised educational program use.
Users may not copy, reproduce, record, distribute, publish, sell, license, modify, translate, adapt, create derivative works from, publicly perform, or commercially exploit Bodhi content without written permission.
Teachers and schools may use Bodhi materials only within the authorised school program and only for the duration and scope approved by Bodhi.
20. Third-Party Services
Bodhi may use or connect with third-party services, including hosting providers, databases, authentication tools, payment gateways, crash/error monitoring tools, analytics tools, push notification systems, app stores, website analytics tools, and support tools.
Use of third-party services may be governed by their own terms and privacy policies.
Bodhi is not responsible for third-party outages, payment failures, app-store decisions, network issues, cloud interruptions, or third-party service disruptions beyond Bodhi’s reasonable control.
21. Privacy and Data Protection
Use of Bodhi is governed by the Bodhi Privacy Policy.
The Privacy Policy explains what data Bodhi collects, why it is collected, how it is used, who it may be shared with, how long it may be retained, and what rights users, parents, guardians, schools, and teachers may have.
Bodhi does not sell personal data. Bodhi does not use child data for targeted advertising. Bodhi does not use screen recording, session replay, or heatmap analytics in the student-facing mobile app.
22. Wellness Disclaimer
Bodhi provides general meditation, focus, reflection, breathwork, self-regulation, and wellbeing-practice content.
Bodhi does not provide medical advice, therapy, psychiatric advice, diagnosis, treatment, counselling, crisis intervention, or emergency assistance.
Bodhi does not guarantee that use of the app will improve mental health, academic performance, emotional wellbeing, focus, discipline, relationships, stress levels, behaviour, or any other outcome.
Users should consult qualified professionals for medical, psychological, psychiatric, counselling, educational, or emergency concerns.
If a user feels unsafe, at risk of self-harm, harmed by someone else, or in immediate distress, they should stop using the app and seek urgent help from a trusted adult, parent, guardian, school counsellor, doctor, emergency service, or crisis helpline.
23. No Guarantee of Results
Bodhi is a practice-support platform. Results depend on many factors, including consistency, age, environment, health, family support, school context, sleep, lifestyle, willingness to practice, and individual differences.
Bodhi does not guarantee:
- reduced anxiety or stress;
- improved exam performance;
- improved focus;
- improved discipline;
- improved behaviour;
- improved mental health;
- improved school outcomes;
- specific emotional, academic, spiritual, or personal transformation.
Any examples, testimonials, school feedback, progress indicators, or reports are illustrative and do not guarantee similar outcomes.
24. Availability and Changes
Bodhi may modify, add, remove, suspend, or discontinue features, content, subscriptions, school programs, tools, pricing, or access models from time to time.
We may do this for reasons including product improvement, safety, compliance, business changes, school requirements, technical issues, legal obligations, or user protection.
Bodhi will try to avoid unnecessary disruption, but we do not guarantee that every feature will always be available.
25. Account Suspension and Termination
Bodhi may suspend, restrict, or terminate access if:
- the user violates these Terms;
- required consent is missing, withdrawn, or disputed;
- payment fails or subscription expires;
- school program access ends;
- a class code is misused;
- account information is false or unauthorised;
- there is suspected fraud, abuse, security risk, or misuse;
- continued access may create legal, safety, privacy, or operational risk.
Users may stop using Bodhi at any time. Account deletion may be requested through the in-app deletion mechanism, support process, or web-based deletion mechanism, subject to the Privacy Policy and legal retention requirements.
26. Account and Data Deletion
Bodhi provides an in-app mechanism through which users may initiate account deletion. Users may also request assistance through Bodhi’s support or web-based deletion mechanism.
In-App Deletion Path: Profile → Privacy & Security → Delete Account
Account/Data Deletion Webpage: https://bodhi.org.in/delete-account
Support Email: support@bodhi.org.in
When a deletion request is made, the account may remain recoverable for 7 days. During this 7-day recovery window, the user may be able to restore the account and associated app data.
After the 7-day recovery window expires, the user profile and associated app data are deleted or de-identified from active systems and cannot be restored through normal account recovery.
Account deletion may result in loss of:
- profile data;
- linked parent/guardian profile data;
- subscription-linked app access;
- practice history;
- Thought Bank entries;
- Dopameter data;
- Karma-related user data where applicable;
- League participation;
- class-linked progress;
- personal settings.
Because Bro conversations are not stored after the interaction/session, they are not part of retained account history.
Some records may be retained separately where required or reasonably necessary for legal, tax, payment, accounting, invoice, security, fraud-prevention, consent, dispute-resolution, backup-cycle, or school-program purposes.
Deleting the app from a device does not automatically cancel subscriptions purchased through Apple In-App Purchase, Bodhi’s website, Razorpay, school invoice, or another payment method. Users must cancel subscriptions through the relevant platform or payment method.
27. Limitation of Liability
Bodhi is a self-regulation, meditation, focus, reflection, and wellbeing-practice platform. Bodhi does not guarantee any specific outcome, including improvement in focus, behaviour, emotional wellbeing, academic performance, stress levels, discipline, habits, sleep, relationships, or mental health.
To the maximum extent permitted by applicable law, Neurosynthesis Lab, Bodhi, Shyam Hitendra Trambadia, employees, contractors, partners, licensors, service providers, and affiliates shall not be liable for any claim, loss, damage, cost, or expense arising from:
- a user’s reliance on Bodhi for medical, psychological, psychiatric, counselling, emergency, academic, behavioural, or professional advice;
- failure to achieve any expected result from using Bodhi;
- emotional distress, academic loss, personal disappointment, relationship issues, behavioural outcomes, or lifestyle outcomes;
- user misuse of the app, Thought Bank, Bro, Dopameter, League, Karma, reminders, or other features;
- inaccurate information provided by users, parents, guardians, schools, or teachers;
- failure by a parent, guardian, school, or teacher to supervise or support a child where appropriate;
- interruption, suspension, modification, or discontinuation of any feature;
- third-party service failures, including payment gateways, cloud providers, authentication providers, app stores, notification systems, analytics systems, or internet providers;
- loss of data caused by user action, device failure, unauthorised access, force majeure, or third-party service failure, except where caused by proven wilful misconduct or gross negligence by Bodhi.
Bodhi’s responsibility, if any, is limited to providing access to the app and its available features according to the applicable plan, subject to these Terms.
Nothing in these Terms excludes liability that cannot be excluded under applicable law, including liability arising from proven fraud, wilful misconduct, gross negligence, or any statutory consumer right that cannot legally be waived.
Where a refund, credit, extension, adjustment, or other resolution is offered by Bodhi, it may be provided as a goodwill or customer-support measure and shall not be treated as an admission of legal liability.
28. Indemnity
To the extent permitted by applicable law, adult users, parents, guardians, teachers, schools, authorised school representatives, and institutional users agree to indemnify and hold harmless Neurosynthesis Lab, Bodhi, Shyam Hitendra Trambadia, employees, contractors, partners, licensors, service providers, and affiliates from claims, losses, liabilities, damages, costs, and expenses arising from:
- misuse of Bodhi;
- violation of these Terms;
- violation of another person’s rights;
- unauthorised use of a school, class code, profile, or account;
- unlawful or harmful content submitted through Bodhi;
- misuse of Bodhi reports, data, Karma, or school-linked features;
- breach of consent obligations where the person acted as a parent, guardian, teacher, school, or authorised representative.
This clause does not require a child user to personally indemnify Bodhi.
29. Force Majeure
Bodhi will not be responsible for delay, failure, interruption, data loss, or inability to perform caused by events beyond reasonable control, including internet failures, cloud outages, cyberattacks, power failures, natural disasters, government actions, war, riots, labour issues, app-store actions, regulatory changes, payment gateway failures, or third-party service disruptions.
30. Governing Law and Jurisdiction
These Terms are governed by the laws of India.
Subject to applicable consumer protection laws and mandatory legal rights, courts at Ahmedabad, Gujarat, India shall have jurisdiction over disputes relating to these Terms or Bodhi.
31. Dispute Resolution and Grievance Redressal
If a dispute, complaint, privacy request, deletion request, consent request, subscription issue, or grievance arises, users should first contact Bodhi using the contact details below.
We aim to acknowledge consumer complaints within 48 hours and resolve them within one month from receipt, subject to applicable law and the nature of the complaint.
Privacy and data-protection grievances will be handled within the period required by applicable law.
Nothing in these Terms prevents a user from exercising rights that cannot be waived under applicable law.
32. Changes to These Terms
Bodhi may update these Terms from time to time.
When material changes are made, Bodhi may notify users through the app, website, email, school communication, or another appropriate method.
Continued use of Bodhi after updated Terms become effective means the updated Terms apply. Where required by law, Bodhi will seek renewed consent.
